The CLE will discuss Google, the world's third-largest technology company, and its development of a business model that is almost entirely dependent on innovative forms of Internet advertising. The use of "adwords" has accounted for $25 billion of Google's revenue in 2009. However, the use of adwords raises some very difficult trademark law issues. For example, if Nike buys the word "Reebok," so that users searching for "Reebok shoes" are shown an ad for Nike shoes on the Google search page, is Nike infringing Reebok's trademark? Is Google? Are consumers "likely to be confused" by this use of Reebok's mark? These questions turn out to be a great deal more complicated under current trademark law than they might appear. These issues are the subject of much recent (and on-going) litigation. Professor Post will untangle these issues and try to help us all become less likely to be confused by the legal issues involved.
